1. General provisions

1.1. This document is a public offer of the State Institution “Arena Cultural and Sports Complex” (hereinafter referred to as the “Contractor” or the “Arena”), located at: Republic of Kazakhstan, Semey, Karagaily microdistrict, building 39, addressed to an unlimited number of persons (hereinafter referred to as the “User”).

1.2. Use of the Arena services, payment, submission of an application or any other request to the Contractor means the User’s unconditional acceptance of the terms of this offer in full in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.

1.3. This offer regulates the provision of the following services:

• rental of premises, playing areas and the adjacent territory of the complex;
• sale of tickets for sports, cultural and other events;
• rental of VIP boxes (Sky Boxes) — Sky Hall and VIP 1–4;
• provision of memberships, access to the swimming pool and sports sections;
• use of the park territory of the complex.

2. Subject of the agreement

2.1. The Contractor undertakes to provide the User with the selected service under the terms specified in this offer and valid at the time of acceptance, and the User undertakes to pay for and accept the service properly.

2.2. The specific type, scope, cost and term of the service are determined on the basis of the User’s application, price list and/or additional agreement, which form an integral part of this agreement.

2.3. The cost of renting VIP boxes (Sky Boxes), event premises and long-term rental is provided upon individual request through the sales department.

3. Procedure for concluding the agreement and acceptance

3.1. The agreement is considered concluded from the moment the User performs any of the following actions:

• full or partial payment for the service;
• submission of an application through the website, messenger or by phone confirmed by the Contractor;
• actual use of the service or access to the territory of the complex.

3.2. For legal entities and individual entrepreneurs requesting rental of premises, Sky Boxes or event organization, the Contractor has the right to conclude a separate written agreement.

4. Cost of services and payment procedure

4.1. The cost of services is established in accordance with the current price list of the Contractor. The Contractor has the right to change the cost unilaterally by publishing up-to-date information on the official website and at the administrator’s desk.

4.2. Payment is made in cashless form, by bank card or by other available methods offered by the Contractor.

4.3. The service is considered paid after funds are received by the Contractor or after payment is confirmed by the payment system.

5. Rights and obligations of the parties

5.1. The Contractor undertakes to provide services in accordance with the terms of this offer, ensure proper conditions for visitors and provide necessary information about the services.

5.2. The User undertakes to comply with the rules of visiting the complex, pay for the selected services on time, treat the property of the complex with care and follow safety requirements.

5.3. The Contractor has the right to refuse to provide a service if the User violates the rules of conduct, safety requirements or payment terms.

6. Cancellation, refund and transfer of services

6.1. Refunds and transfer of services are carried out in accordance with the rules of the complex and the current legislation of the Republic of Kazakhstan.

6.2. If an event is cancelled or postponed by the organizer, ticket refund or transfer conditions are determined by the organizer and/or the Contractor.

7. Responsibility of the parties

7.1. The parties are responsible for non-performance or improper performance of their obligations in accordance with the legislation of the Republic of Kazakhstan.

7.2. The Contractor is not responsible for the User’s personal belongings left unattended on the territory of the complex.

8. Safety rules

8.1. The User is obliged to comply with public order, fire safety rules, sanitary requirements and instructions of the administration.

8.2. The administration has the right to restrict access to the complex or remove a visitor who violates the established rules.

9. Force majeure

9.1. The parties are released from liability for failure to fulfil obligations if such failure was caused by force majeure circumstances, including natural disasters, emergency situations, restrictions imposed by state authorities and other circumstances beyond the control of the parties.

10. Personal data

10.1. By submitting an application or using the services, the User consents to the processing of personal data by the Contractor for the purpose of providing the services specified in this offer.

10.2. Personal data is processed in accordance with the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”.

11. Final provisions

11.1. This offer is governed by the legislation of the Republic of Kazakhstan. Disputes are resolved through negotiations, and if no agreement is reached, in court at the location of the Contractor.

11.2. The Contractor has the right to change the terms of the offer unilaterally by publishing the current version on the official website. Continued use of the services after publication of changes means acceptance of the new version.

11.3. The rules for visiting the complex, the price list and the terms of specific services are integral annexes to this offer.
